Acceptance of This Agreement

Welcome to Game ZenithalX (the "Service"), provided by Game ZenithalX ("we," "us," or "our"), accessible at gamezenithalx.top. This User Agreement (the "Agreement") is a legal agreement between You (the "User") and us. By accessing, browsing, or otherwise using the Service, You acknowledge that You have read, understood, and agree to be bound by this Agreement and Our Terms of Service and Privacy Policy. If You do not agree to all the terms of this Agreement, You must not use the Service.

By using the Service, You represent and warrant that: (a) You are at least 13 years of age (or the age of digital consent in Your jurisdiction); (b) if You are under 18, Your parent or legal guardian has reviewed and agreed to this Agreement on Your behalf; and (c) Your use of the Service does not violate any law or regulation applicable to You.

1. Play Respectfully

Use Game ZenithalX and its interactive features for personal, lawful enjoyment. You agree not to:

a. Use the Service for any illegal, unauthorized, or fraudulent purpose;

b. Attempt to disrupt, overload, or impair the proper functioning of the Service, including submitting malware, spam, or excessive requests;

c. Misuse links, impersonate others, or falsely represent Your affiliation with any person or entity;

d. Submit harmful, abusive, defamatory, obscene, or infringing content;

e. Reverse engineer, decompile, or disassemble any part of the Service;

f. Use automated tools (bots, scrapers, crawlers) to access or collect data without Our prior written permission;

g. Use the Service to send unsolicited communications, advertising, or promotional material;

h. Encourage or induce any third party to engage in any of the above conduct.

2. Your Contributions and User Content

If the Service permits You to submit reviews, ratings, messages, or other content ("User Content"), You agree to the following:

a. You remain solely responsible for Your User Content, including its accuracy, relevance, legality, reliability, and appropriateness.

b. You must keep Your User Content relevant, honest, and free of private or confidential information belonging to others.

c. You represent that You have all necessary rights, licenses, and consents to submit Your User Content and that it does not infringe any third party's intellectual property, privacy, or other rights.

d. You grant Game ZenithalX a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable license to use, host, store, reproduce, modify, display, distribute, and otherwise exploit Your User Content for the purpose of operating and improving the Service.

e. We do not claim ownership of Your User Content. You retain all rights You already hold in Your User Content.

3. A Shared Standard — Content Moderation

We reserve the right, but are not obligated, to monitor, review, moderate, edit, or remove any User Content that is abusive, misleading, discriminatory, spam, infringing, unlawful, or unrelated to the game or topic being discussed. We may take these actions without prior notice and at Our sole discretion. This helps keep the library welcoming and safe for all users.

We are not liable for any User Content posted by users. We do not endorse and are not responsible for the accuracy or reliability of any User Content on the Service.

4. Third-Party Games and Links

The Service embeds and links to browser games and third-party web sites that are not owned or controlled by Us. We do not control and are not responsible for the content, functionality, availability, privacy practices, or terms of these third-party games and sites. Your interactions with third-party games and sites are solely between You and the third party. 5. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, design, layout, software, and code—are the exclusive property of Game ZenithalX and its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without Our prior written consent. Game thumbnails, descriptions, and other media are the property of their respective publishers and are displayed for discovery and informational purposes only.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY GAME DESCRIPTION, LINK, OR CONTENT.

7. Limitation of Liability

IN NO EVENT SHALL GAME ZENITHALX, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY THIRD-PARTY GAME OR CONTENT; OR (C) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS, OR, IF YOU HAVE NOT PAID ANYTHING, TWENTY U.S. DOLLARS ($20.00).

8. Indemnification

You agree to defend, indemnify, and hold Game ZenithalX harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, or expenses (including but not limited to attorney's fees) arising from or relating to: (a) Your use of or access to the Service; (b) Your User Content; (c) Your violation of this Agreement or any law or third-party rights; or (d) Your violation of any rights of another person or entity.

9. Account Termination and Deactivation

You may request deletion or deactivation of Your account at any time by contacting Us at [email protected]. We will take reasonable steps to remove Your personal data in accordance with Our Privacy Policy and applicable law.

We may terminate or suspend Your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to: (a) Your breach of this Agreement; (b) Your violation of any law or third-party rights; or (c) Your conduct that We determine is harmful to the Service or other users. All provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to intellectual property, disclaimers, limitation of liability, and indemnification.

10. Changes to This Agreement

We reserve the right to modify or replace this Agreement at any time at Our sole discretion. We will try to provide at least 30 days' notice prior to any new terms taking effect by posting the updated Agreement on this page. By continuing to access or use the Service after the revisions become effective, You agree to be bound by the revised Agreement. If You do not agree to the revised Agreement, You must stop using the Service.

11. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to this Agreement or the Service shall first be attempted to be resolved through good-faith informal negotiation for a period of sixty (60) days. If the dispute cannot be resolved through informal negotiation, it shall be finally resolved by binding arbitration conducted by a single arbitrator, with the proceedings conducted in English. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

You and Game ZenithalX agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. This section does not prevent either party from seeking injunctive or other equitable relief to protect intellectual property rights.

12. Governing Law and Jurisdiction

This Agreement and Your use of the Service shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. For any dispute not subject to arbitration under Section 11, You and Game ZenithalX agree to submit to the exclusive jurisdiction of the courts located in Beijing, China, which shall be the competent court for resolution of any such disputes.

13. Entire Agreement

This Agreement, together with Our Terms of Service and Privacy Policy, constitutes the entire agreement between You and Game ZenithalX regarding the Service and supersedes all prior agreements, understandings, and communications, whether oral or written. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
